My Last Will & Testament

This is the last Will and Testament of Roy Douglas Benham, currently living at ##, Liverpool ##

Until being signed my Pre 2009 Will is still active, however the Trustees have ceased trading, and the whereabouts of the Will are unknown.
Previous Beneficiaries - Thomas Gordon Benham & Alexandria Margaret Benham, in equal share

1. Revocation

I, Roy Douglas Benham, also known as Beth Nicole Gordon, born on 1st July 19##, and being of sound mind, do hereby revoke all former Wills and testamentary dispositions made by me and hereby make, publish and declare this to be my last Will and Testament.

2. Preliminary Declarations

1) I am divorced.
2) I would like to be cremated.
3) I have included an Appendix to this my Will which although a non-testamentary document, has
been placed with my Will to assist my Trustees in matters such as arranging my funeral and
delivering personal messages to some of my beneficiaries where specified.

3. Appointment of Executors and Trustees

1) I appoint as my trustees those of my executors who obtain a Grant of Probate for this Will and in
this Will the expression ‘my Trustees’ shall mean, as the context so requires, either the executor, the
executors and/or trustees of my Will whether original, substituted or added.
2) I appoint Zenda Trust Company (UK) Ltd of Booths Hall, Booths Park, 3 Chelford Rd, Knutsford,
Cheshire WA16 8GS to be the sole executor and trustee of my Will.

I may replace this Trustee company with a suitable friend or acquaintance 

4. Definition of Estate

"My estate" shall mean all my legal and beneficial interests in property, money and possessions.

5. Distribution of Estate

I gift all my estate not otherwise disposed of by my Will to my executors to use it to pay my debts, funeral and testamentary expenses and to any legacies declared earlier and all tax payable in respect of my estate, and to divide my residuary estate among the following in the shares specified.

My brother Anthony Benham
My niece Josephine Benham
My friend Meghann Shaw
My friend Samantha Henderson

If any of the gifts set out here fails to pass to a named beneficiary, it should be added proportionally to the gifts that do not.

6. General Provisions

1) The Standard Provisions and all of the Special Provisions of the Society of Trust and Estate
Practitioners (3rd Edition) shall apply.
2) Everyone who would otherwise benefit under this Will but who fails to survive me by 28 days
shall be treated for all purposes connected with the devolution of my estate as having predeceased me
and my estate, together with any intermediate income produced, shall devolve accordingly.
3) For the avoidance of doubt, clause headings in this my Will shall not be deemed to be part of my
Will.

7. Final Declarations

I confirm that
a. I am mentally capable of making my own decisions about my Will;
b. I am voluntarily making this Will;
c. I have considered everyone I might reasonably be expected to be provided for by my Will;
d. I understand the contents of this Will and it is a true reflection of my wishes.

8. Final Clause

This is the last clause of my Will and is only followed by an attestation statement

I Roy Douglas Benham the within named Testator have to this my last Will set my hand. I declare
that this instrument is my last Will and that I am of the legal age to make a Will, and that I sign this
Will freely and voluntarily.

Appendix

This Appendix is a non-testamentary document but has been placed with this Will to assist my
executors in preparing my funeral and to deliver personal messages I have written to my beneficiaries.

In the event that my son has not survived me, then it is my wish his share must be passed to the other beneficiaries and not any of his family, with his sister sadly not wishing to be a part of my life and I have no other connections with their family.

To my other beneficiaries, whether family or friends, they receive a share to help support the futures of their families.

Funeral Instructions

I desire that my body be cremated and the expense thereof shall be a first charge on my estate. I also
request I have no preferences on where my ashes are placed.

My preference of funeral director is Debbie Bennett Funeral Directors, 31 High Street, Prescot, Liverpool, L34 6HE

Pension L&G = £36,000
M&S Death in Service = £42,000
Half property value = £90,000
allowance for funeral and probate = -£10,000
Net Value = £225,000 = approx £45,000 per estate share

Change of Name

In the event that I proceed with my name change then the content of my Will shall not be changed.
